Franchisor Personal Information Collection Notice

Harcourts Group (Australia) Pty Ltd (ACN 074 304 073) (Harcourts, we, us, our) is the Australian franchisor for the Harcourts real estate franchise network. This collection notice applies where Harcourts collects personal information from you, including through Harcourts' websites, digital forms, enquiry channels, franchise network systems, training, support, compliance, marketing and other franchisor activities.

How we collect your personal information

We may collect personal information directly from you when you make an enquiry, complete a form, subscribe to or request information from us, use our websites or digital platforms, enrol in our courses, communicate with us by telephone, email or in person, attend Harcourts events or training, apply for a role or franchise opportunity, and participate in marketing, support, complaints, dispute resolution, compliance or network activities.

We may also collect personal information from third parties, including your representatives, referees, Harcourts' franchisees and related entities, and service providers. This may include information collected by Harcourts' franchisees or their service providers for customer due diligence, identity verification, compliance, audit, reporting or other AML/CTF-related purposes.

The purposes for which we collect, hold, use and disclose your personal information

We will collect, hold, use and disclose your personal information for purposes including:

  • operating a national real estate network for Harcourts' franchisees to provide services for the buying, selling, leasing, development and advertising of residential, commercial and rural properties, business broking, training and providing services in connection with arranging utility connection, removalists, cleaners, conveyancing, financing and insurance;
  • responding to your enquiries;
  • providing you with products and services;
  • providing you with marketing information about our products and services and other third parties with whom we have business partner relationships;
  • obtaining your feedback on your customer experience;
  • conducting promotional activities;
  • our general business (including to conduct business functions including providing personal information to third parties, including our employees, contractors and service providers);
  • conducting market research;
  • recruitment;
  • maintaining our business records;
  • compliance with legal and insurance obligations;
  • statistical purposes;
  • credit reporting bodies and tenancy database operators;
  • to comply with any law, rule or regulation or decision of a regulator or Government authority, including AML/CTF laws (see below) and requirements that may apply to us, Harcourts' franchisees or service providers engaged in connection with the Harcourts network; and
  • for purposes otherwise set out in our Privacy Policy.

Who may we disclose your personal information to?

We may disclose your information to Harcourts' franchisees and Harcourts' related entities, service providers, technology providers, marketing providers, professional advisers, insurers, regulators, government agencies, law enforcement bodies, AML/CTF compliance providers, identity verification providers and other third parties where required or permitted by law, including under AML/CTF laws, or as otherwise set out in our Privacy Policy.

Overseas Disclosure

Some of our service providers, related bodies corporate, franchise network providers and technology providers may receive, store and process personal information outside Australia. Your personal information may be disclosed to overseas recipients, including recipients located in Canada, India, Ireland, Japan, New Zealand, the United Kingdom and the United States of America, and such other countries as set out in our Privacy Policy.

Where this happens, we will take reasonable steps to ensure that your personal information is handled in line with the Australian Privacy Principles made under the Privacy Act 1988 (Cth), including through contractual protections with our providers.

If you do not provide your personal information to us

If you choose not to provide some or all of the personal information that we request, we may not be able to respond to your enquiry, provide requested information, services or support, progress your application, account, request, complaint or participation in Harcourts systems or activities, or assist you fully or at all.

AML/CTF laws and other collections required or authorised by law

In some circumstances, our Harcourts franchisees are required or authorised to collect your personal information under laws including the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) (AML/CTF laws), related AML/CTF rules and regulations, real estate, property, taxation, corporations, employment, consumer protection and record-keeping laws.

If you have a transaction or relationship that is subject to AML/CTF requirements under AML/CTF laws, we, Harcourts' franchisees and their AML/CTF compliance providers or identity verification providers may collect, hold, use and disclose your personal information to perform customer due diligence, verify your identity, conduct screening, comply with audit, reporting and record-keeping obligations, prevent fraud and satisfy other AML/CTF compliance requirements. This may include handling identity information, government-issued identification details, copies of identification documents, beneficial ownership information, source of funds or wealth information, transaction information and biometric information, where required or permitted by law.
